Use of personal data

Access to several sections of this website (“WebSite”), and/or any information or services request by its users, may be conditional upon the user’s entry of personal data (“Personal Data”). The processing of these data – done by Barilla G. e R. Fratelli Società per Azioni, with corporate seat in Parma (Italy), Via Mantova 166 (“Barilla” or “Controller”), in its capacity as Controller of the processing of Personal Data – will be performed in compliance with the Italian Legislative Decree No. 196/2003 on the protection of personal data (hereinafter referred to as the "Code"). The purpose of this information is to make users aware of how Barilla processes their personal data, even before they access the various sections of the Website and provide their Personal Data. In any case, the users will be required, to read this information before providing Personal Data and compiling the specific forms in the various sections of the Website.

Purposes of the data processing

Depending on the needs of the users accessing the various sections of the Website, Personal Data gathered directly from the users (through compilation of online forms) may be used in the following ways: a) to allow the registration on the Website, which is required not only to access certain sections of the Website itself but also to provide and manage the various services offered; b) subject to the users’ prior specific consent and as long as this consent is not revoked, to carry out marketing activities (such as, for example, sending promotional and/or advertising material and/or performing related analysis on registered users to allow Barilla to improve the products and services offered to its customers), including via e-mail, fax, mms and sms; c) to send newsletters via e-mail containing updates on the Website, recipes, menus, nutritionist advice, and many other news on the Barilla world and on the best Italian gastronomy (Website section "Subscribe to the Newsletter") contingent upon the users’ prior specific consent and as long as this consent is not revoked; d) to respond to any users' request regarding Barilla products, advertising, or website (Website section "Contacts"). User registration is not required to access some specific services offered by Barilla (e.g. those included in paragraph d) above). However, in order to respond to any request concerning these services, the users will be invited to provide Personal Data which will be used only for the specified uses and for a period of time strictly required.

How Personal Data will be processed

Personal Data will be mainly processed in an automated way, with procedures strictly related to the purposes given in sections a), b), c) and d) above. Failure to supply mandatory Personal Data required for the services requested and marked with an asterisk – or the supply of partial or incorrect Personal Data – will make it impossible for these activities to be fulfilled; the failure to supply optional, non-mandatory Personal Data (whether provided in-full, partially, or incorrectly) will not impede the fulfillment of such services.

Categories of personal data processed

In addition to Personal Data provided directly by the Users during the connection to the Website (such as name, surname, postal address, e-mail address, etc.), the IT systems and software programs used in order to run the Website itself indirectly gather certain personal data, whose transmission is understood as being implicit in the use of Internet communication protocols. Such data will be used only for anonymous statistical studies.

Subjects who may process the Personal Data

Personal Data may be accessed by the employees or co-operators of the divisions of the Controller who, operating under the direct authority of the latter, are appointed as Processors or persons in charge of the processing of Personal Data, pursuant to Articles 29 and 30 of the Code, and will therefore receive, in this regard, proper operating instructions. The same instructions shall be provided by the persons in charge (appointed by the Processor) to its employees or co-operators.

Communication or diffusion of user Personal Data

Personal data supplied directly by the Users by filling out the online forms will not be divulged or communicated to third parties, with the exception of employees and co-operators of the divisions of either the Controller or the Processors appointed by the Controller.

Controller and Processors of the Personal Data

The Controller of the Personal Data processing is Barilla G. e R. Fratelli Società per Azioni, headquartered in Via Mantova, 166, Parma 43122;
Processors of the Personal Data are:
1) Controller’s Group Communications and External Relations, Information Technology, Marketing, and Trade Marketing Departments;
2) Barilla Quality Insurance Service , as for technical information on the products;
3) Promoservice S.r.l, with registered office in Parma, Viale Mentana n° 92, 43121, as for any request of both information and promotional/advertising material;
4) Fullsix S.p.A., with registered office in Milano, Viale del Ghisallo 20, 20151, as for the collection of the data and the management of both the Website and the server which hosts the Website;
5) ContactLab S.r.l., with registered office in Via Natale Battaglia, 12 - 20127 Milano, as for the dispatch of promotional and advertising material.

Users' right pursuant to Article 7 of the Code

"Article 7 – Right of access to personal data and other rights
1. The party concerned has the right to obtain confirmation of whether or not any personal data concerning him/her exist (even if not yet registered), as well as the right to obtain their communication in an intelligible form.
2. The party concerned has the right to information concerning:
a) the source of the personal data;
b) for what purpose and how they will be processed;
c) the methodology used for processing by electronic means;
d) information identifying the Controller, Processors, and designated representatives within Italy, where required;
e) the subjects or types of organization which personal data may be divulged to or shared with, in their role of either designated representative within Italy, or Processors, or assigned personnel.
3. The party concerned has the right to obtain:
a) updates, changes or, where relevant, additions to the data;
b) deletion, transformation in anonymous form, or blocking of data processed in violation of the law, including information not required to be stored for the purposes for which it was gathered or subsequently processed;
c) confirmation that the processes referred to in section a) and b), including specific content, have been brought to the attention of those to whom the information has been communicated or shared, except in the event this action proves impossible or would entail the use of means clearly disproportionate to the right in question.
4. The party concerned has the right to oppose (either totally or in part):
a) for legitimate reasons, the processing of personal data involving him/her, even though such data pertains to the reason it was gathered:
b) the processing of personal data involving him/her for the purposes of sending advertising or direct marketing material, or for carrying out market research or business communication.”
The above-mentioned rights may be exercised directly or through their delegation in writing or via proxy to other individuals or associations.

The user may, at any time, exercise his/her rights pursuant to Article 7 of the Code, as well as obtain the complete list of the Processors by sending either a message via electronic mail to the Controller at webline@mail.barilla.it, or a letter via regular mail to: BARILLA G. e R. In addition, upon his/her consent, the user may oppose the processing for the purposes outlined in sections b), c) and d) using the user’s own e-mail address, by clicking on the specific “link” found in the e-mail message.

How to modify the user's profile
